Effective blogging

Blogging is a great way to market your law firm. When done well it can be a great marketing/branding tool and can gain strong visibility online in addition to increasing the visibility of your website. Here are a few key tips on how to write an effective blog:

Blog writing with SEO:

1. Style of writing. Remember who your audience is and write for that audience. If you expect that non legal professionals will be the main audience for your site then make sure you keep the language in layman’s terms.
2. Topics to write about. Stuck on what to write about? Think of every question a client has ever asked you – each one is an opportunity to write a blog posting! In addition share your thoughts and commentary on recent new events which are relevant to your practice, talk about recent events in your practice etc…
3. Focus. Keep the topic of your blog as focused as possible around the area(s) of law in which you practice.
4. Keywords. Your blog posting should be as rich as possible with keywords but remember that it still needs to read well. Don’t simply say ‘criminal lawyer’ 20 times in one post as Google can consider that ‘keyword stuffing’ which could result in a penalty and of course when someone reads the blog it will sound terrible. So make sure the post reads well however do use as many keywords as possible. In addition try to use those keywords in sentences which make sense but also in a way that people might use them when searching. For example you could start a posting by saying ‘Orange County Estate Planning Attorney Bob Jones was recently blah blah……..’. The first 5 words are clearly what someone could enter into a search engine.
5. Blog post titles. The title of your blog post is very important. Make sure that you use keywords in the title.
6. Hyperlinks with anchor text. In your postings you should link to your website where appropriate. Create links to the home page of course but be sure to create plenty of links to the internal pages of your website also. For example if you write a post on Chapter 7 bankruptcy laws then link to your Chapter 7 page. Create a hyperlink from the relevant words. So for example if the blog was about Chapter 7, highlight Chapter 7 and then click the link button (usually looks something like this ) and then enter the url of the page you want to link to on the screen that will pop up. Click ok and you have now linked those words to the relevant page.
7. Inbound links. Make sure that your blog is linked to your website and your website is linked to your blog. In addition you should create as many inbound links to your blog as possible from as many different websites as possible. If you know other attorneys who blog ask them to write a post about you and link to your blog and of course you will do the same for them (make sure that no more than 50% of your links are these ‘reciprocal’ links however as more than that will not look good to Google). Do a search for ‘blog directories’. You’ll find a slew of blog directories many of which you can create a listing with free of charge.
8. Blog regularly. The more often you blog the more credibility your blog will gain and the more it will help your website results. I would recommend a minimum of 1-2 times per month to make it worthwhile. Any less than once a month and it’s probably not going to do much for you.

It's not news to anyone that the internet is booming. These days people shop online, they find their partners online and they navigate almost every aspect of their lives online. Just so far today I've used my phone's navigation system to get to a meeting, I used an app on my phone to scan a business card and enter the information into my computer and I'm about to use another app to deposit a check into my bank and it's only 10am!

Despite the web being so prevalent in the lives of most people these days I find that some law firms are still slow to adapt.

There are several examples of once mighty businesses which have now failed or are failing, the most recent being Borders. Once a thriving business they are now going out of business as they simply didn't adapt to the world going online.

In the legal sector it's no different. More and more people use the web as a means of finding legal information as well as representation. Why use the web? People are busy and in a hurry - the web provides instant gratification. Many people start out by searching for information regarding their problem and if they find your law firm website during that search it's highly likely they will call you.

So if you have yet to adapt to the internet age, my question to you, a successful firm that gets business from relationship and referrals, is when do you want to begin? You can choose to be a firm that continues on business as usual as the world changes around you and risk the consequences. Or, you can pro-actively learn, understand and participate in the new market space. I highly suggest the latter.

Converting calls to clients

So you've invested in marketing your website and the calls are starting to come.....but how do you do the best job of:

a) Making sure you don't waste your time on people who can't afford to pay you

b) Converting the quality callers into paying clients

With regards point b here's a blog posting I wrote a few months ago regarding how quickly you return phone calls/emails from prospective clients. Click here But to give it to you in a nutshell - when you get a call/email for the first time from a prospective client, if you (or someone in your office) doesn't call them back within the first hour, the chances are you will never reach them (as by then they are talking to another attorney instead).

When you do reach them, here are 3 questions you should ask a new caller right away:

1. Why do you feel you need an attorney
2. What do you do for a living
3. How do you plan to pay for an attorney

The reason for question 3 is that it could be a doctor who is in bankruptcy, or an unemployed person with a large trust! It's important to ask what they do for a living but don't fall in to the trap of making assumptions based on that response. If the answers to these questions lead you to believe that they either don't have a good case/legal need or they can't pay you, politely end the call.

Assuming that you have someone with a good case/legal need and it appears that they will be able to pay you then get them into your office AS SOON AS POSSIBLE.

Once in your office this is when you need to put on your sales hat. Here are a few basic sales techniques/tips which will help:

1. Try 'mirroring' your client. If they talk quickly, you should talk quickly. If they are slumped in their seat, you should be relaxed too. People often identify with people who are like them.

2. Make sure to empathize with their problem or situation. Clients need to feel understood.

3. Don't assume the client knows about your background/experience with this area of law. They may have researched you but assume they haven't and make sure you fully explain your relevant credentials. Be sure to explain the potential problems of them either trying to handle their issue alone, or going with an inexperienced attorney.

4. Make sure you have a good idea why people should retain you. It might sound obvious but I can't tell you how many times I've asked an attorney this quesiton and they don't know the answer. Know why you are good and what you do well and convey this to the client.

5. Give them enough legal information to satisfy their questions but focus more on how you can help them rather than teaching them the law. If you believe in education that's fine, but you can go into more detail as you work with them further down the road.

6. Try to get the client to sign an agreement when they are with you.

7. If the client does not sign up when with you make sure you have good follow up. After a couple of days call on them to ask if they have made a decision or if they have additional questions you can answer. If you want to be creative/stand apart from the crowd you could even record a video message (you can just use your phone) to send to the client.

One last tip:

Record yourself on the phone talking to a client and then listen to it back again. Ok you'll only hear one side of the conversation but listen to yourself - would you hire you? Several times I've been in an attorney's office and have been shocked to hear how they talk to clients/prospective clients. The US has 60% of the world's attorneys - people have many choices so remember that when you talk to them.

San Franciso bans Yellow Pages!

Since the online boom the use of Yellow Pages has been declining steeply, and now the latest blow to the dying business is San Francisco's ban on Yellow Pages deliveries unless the book is specifically requested by the customer.

San Francisco Department of the Environment President David Chiu advised that the city receives over 1.6 million Yellow Pages books when they have only 800,000 residents. This causes nearly 7 million pounds of waste annually which costs the city about $350,000 per year in disposal.

San Franciso isn't the first city to make this move - Seattle has a similar ban already and I'm sure that many other cities are going to follow. Yellow Pages is of course trying to fight back by saying it will cause lost revenue for them. Yup.....but isn't it just speeding up what's inevitble anyway? It's undeniable that Yellow Pages ceasing to exist at all in only a matter of time.

Online success with limited budget

Especially in today's challenging economic climate, a common question from attorneys I talk to is how they can be successful online with a limited budget considering that many of the firms they compete with are larger and have big budgets.

The answer is that you can and it's quite simple - start off with a narrow focus.

The way that it works is this - the more competitive the practice area/topic you want to be found for, and the more topics you want to be found for the more it's going to cost to get a site to rank well. Now of course if you have a good site and good rankings/traffic you will get a good return on that investment, however that's a mute point if you don't have the initial investment. However if you start off with just one practice area (if it's not competitive) or one matter within a practice area you can create a good presence and do well on a much smaller budget.

One example would be a FindLaw client in Riverside who practices family law which is a competitive area. To get a good presence for family law, divorce etc...isn't easy because it's competitive however we created a site for him which focused solely on father's rights. Because the site had a narrow focus it was quickly on page 1 for relevant phrases, performed really well and generated a steady stream of business. Once the site was bringing a good return on investment the attorney then had the funds to release a fuller website covering every family law matter however that little father's rights website is still around today and still continues to be a revenue producer!

So don't think you need big bucks to compete online - you don't, you simply need a smart strategy.

Comscore is the leading independent web analytics organization which publishes annual web traffic reports. Yet again their most recent report shows that FindLaw is the #1 legal website and the #1 legal directory. To give a quick run down of data ComScore provided:

- FindLaw has approximately 2.2 million visitors monthly.
- 50% more people go to FindLaw over the nearest competitor.
- More than 7 million pages were viewed monthly on FindLaw as opposed to 3 million on the nearest competitor.

Are you making the most of your online leads?

Harvard Business Review recently published a very interesting article which focused on the short life of online sales leads. The article highlighted the importance of a speedy response to online sales leads since the time taken has a massive impact on how likely a business is to qualify the lead.

HBR conducted a study which involved analysing 1.25 million sales leads from a mix of B2B and B2C businesses. The study showed that firms which contacted the lead within an hour of receiving a query were nearly 7 times as likely to qualify the lead (meaning they had a meaningful conversation with the key decision maker) as those who tried to contact the customer even an hour later and more than 60 times more likely than companies who left if for 24 hours.

If you're a business lawyer you might be thinking that this applies more to the consumer market? Think again! Just this week one of my clients was telling me that a large California based restaurant chain called his office as they were looking for an attorney to work on some contracts. Sadly he was in court and didn't respond until 2 days later and has yet to hear back from them again. We're guessing he missed the boat.

I have to assume that when someone makes a contact online they perhaps contact several people and whoever responds first is most likely to be retained by the new client. Maybe it's a good time to review the process in place in your law firm and tighten up on response times if necessary.

Congratulations to Gregory Brown for yet another great result for a client! Orange County Mediation and Collaborative Law

Going through a divorce is never pleasant however it doesn't need to be a bitter battle. When both parties end up in litigation it's costly and very stressful and when there are children involved it's tough on them too. Google Local is FREE - make it work for you!

You'll all have seen Google Local (also known as Google Maps or Google Places) which is basically Google's own directory of businesses. If your search appears to be for a local business you'll see a map like this come up in addition to a listing for each of the balloons.

According to Google this map comes up for 1 out of every 13 searches so if your business comes up prominently here it's a great way to get free traffic to your website.

So the burning question that many people are asking........."How do I get my website to come up on Page 1 of Google Local?".

Here's how it works. As with the organic search results, Google wants to bring up those businesses that it feels are the most trusted and the most relevant for the search entered. There are 3 main criteria:

1. Location.
When someone enters a city in a search the closer you are to the downtown or center of that city the better. That doesn't mean that you can't come up if you are on the outskirts of a city but yes, you do have a disadvantage than those businesses that are more central.

2. Information on your place page.
When you fill out your listing (called your place page) be sure to enter as much information as possible. In the categories section, make sure you add as many categories as possible that are relevant to you. Make sure you use at least 1 of the pre determined categories but feel free to add custom categories. In the description field, make sure you put an overview of your practice and list your key practice areas. Don't however make it just a list of practice areas or keywords - make sure you use full sentences. Note: don't be tempted to put keywords in the name of your business - this is against the rules and can get your listing removed.

3. Consistent replication.
You need to make sure that the information you have added to the listing (phone number, address, practice areas etc...) is registered consistently in a variety of places on the web. If Google sees the same information repeated many times on various websites they will assume that the information is likely to be accurate and are therefore more likely to bring up your listing. Make sure that the information you entered matches what is on your law firm website and create local listings with other search engines and other free directories. Register your firm with the local listing centers for Bing & Yahoo and get yourself listed with Yelp and other free directories such as www.dmoz.org and www.laokay.com Create/update your listings on legal directories such as www.findlaw.com www.avvo.com etc....

Getting started - click this link, create a Google account and follow the instructions to see if there is already a Google Local listing for your practice. If there is you should claim the existing listing, if not create a new one.

Improve SEO by fixing your current backlinks

If you know anything at all about SEO (search engine optimization) you'll know that backlinks (also known as inbound links) are essential to the performance of your site. In a nutshell a backlink is a link which is on another website which, when clicked on takes the user to your website. Each link is seen as a vote of confidence for your site and the more votes it gets the higher your website will rank. Creating new inbound links to your site is not easy so here's a quick tip which can really help make a difference - first start by working on improving your current backlinks:

1. For the internal pages of your website to rank in the search engines they need to be linked to the other pages of your site. Check to make sure that all the internal links work properly and that you have got multiple internal links to each internal page.

2. Look at all your current backlinks and make sure that they are all working properly and pointing to the right domain. If you use multiple domains (for example your site resides on www.smithandjones.com but you also own www.smithjones.com) make sure that all the backlinks are pointing to the domain the website actually resides on.

3. Use anchor text to improve the quality of your backlinks. Contact the webmasters of your current links and ask them to use anchor text with relevant keywords. Anchor text is when, instead of listing the actual domain name you make keywords the link. So instead of it saying click here and then listing the domain, it would have keywords as the link. For example: Orange County Estate Planning Lawyer or Riverside Bankruptcy Attorney.

So yes, work on building new links to your site, but don't neglect the basics and make sure your current links are up to par!

Google's new Instant Preview

Well those folks at Google sure have been busy this year! It's been a year chock full of major changes and enhancements to the search engine and the latest change is a pretty exciting one! A few weeks ago Instant Preview was launched. This feature is not available in all areas but for those who have it, you will see that when you simply move your mouse over a link on a search results page you will see a preview of the website without even having to click on it. Exciting stuff! For those that have great looking websites this is excellent. For those that don't it's not good at all as they may see a decline in traffic as people will quite likely not even click on their site at all if they are using Instant Preview. Major changes to Google

If you use the internet regularly to conduct Google searches you will no doubt have noticed that Google has made a significant change to the way search results are brought up. You will probably have seen the map that Google used to bring up with usually 3 or 7 business listed to the right of it. This is called Google Local (or Google Places) and it's Google's own business directory. It's free to register for Google Local and it's always been a good idea to have a presence there however now it's more important than ever since Google has just decided to merge the Google Local results with the regular organic search results. Now, instead of there being 10 organic search results on each page in addition to the Google Local results we are seeing that in some instances there are more Google Local results than organic and many businesses who were previously on page 1 have now been bumped to page 2.

Not all searches have Google Local search results. Here's how it works. If Google thinks you are looking for information - example search could be simply 'divorce', then you won't see Google Local results. However if Google thinks you are looking but a business in a specific area then you most likely will e.g. 'divorce lawyer irvine' is sure to generate Google Local results. Apparently 1 out of every 13 searches brings Google Local results. So if you've not created and claimed your Google Local listing - get to it right away! Click here.

Picking a domain name

Picking a domain name for your site can be a tricky business. You have 3 main options for the words of the domain - here are the 3 options with considerations for each.

1. Firm name. If you plan on using the firm name you should consider what may happen to your practice in the future. As most people know, the age of a website/domain name is one of the components the search engines look at when determining rank of a site so once you've picked your domain name you don't want to change it. If your law firm is called Smith and Smith then smithandsmith.com might seem like a great choice, but what happens if you decide to take on a new parter? I recently had a client who had a page rank of 4 and over 500 inbound links to their site (GREAT for SEO purposes!!) but because of a new partner they were forced to change the domain and had to start all over again with a new one. For this reason it could be a good choice to pick a generic domain if you think there is any chance of the firm changing name.

2. Practice area specific. If your firm is focused mainly on one practice area, or if you are building multiple focus sites then using the practice area is a possible option. Of course familylawyer.com is sure to be already taken but you can get creative and use hyphens and/or geo references to find a unique name. When buying a domain one consideration is that you should be careful not to purchase a domain which has previously been used for spam - if so your site could have a penalty so make sure an SEO expert checks out a domain before you buy it. I'm often asked if buying a keyword rich domain helps with rank. The answer is yes, but only if someone types out the EXACT phrase on the domain. So if you have taxattorneyirvine.com as your domain and someone types 'tax attorney irvine' it can help but if the site is not a great site it most likely still won't come up despite the domain. Plus it depends on how competitive the practice area. PI and criminal are the most competitive practice areas online so even if you have personalinjurylawyer.com you are unlikely to get your site to rank well based on tha domain alone since it's such a competitive phrase. That said if you practice somethinig more niche and you have a keyword domain name it will most definitely be a big help. Of course most of the obvious domains are already gone......but there are still a few gems left out there.

3. Generic. Finally, if you aren't going to use the firm name and don't want to make it practice area specific you could choose something completely generic - that way no matter what happens to the firm name or the practice areas you will be fine. Again most of the obvious ones will be gone - but get creative and you can still find good generic domains. A client of mine recently registered www.californialegalsolutions.com which is I think a great example of a generic domain.

Can a new website perform well quickly?

The performance of a website is dependent upon MANY different factors, one of which being how long a website has been live on the domain name. The search engines want to serve up websites that they trust and which have the most credibility/authority so that their users have a good experience and don't go to a competitive search engine the next time around. The longer your website has existed (without any spam activity associated with it) the more it's trusted by the search engines, therefore the more 'aged' your domain is, typically the better the result of the website. Because of this, many people who don't currently have a website ask me how they can possibly compete against older sites and how long it will take before they start to see results. Here's the reality - yes it will take time for your website to fully get going, however that doesn't mean you can't get results in the first few months if you are strategic about how you start out. One thing that's important is not to try and cover too many practice areas on the site. The more practice areas you cover, the more firms you are competing against and therefore the more difficult it will be to be successful. Keep your initial website as lean as possible with regards practice areas and only cover those you truly practice in frequently. The other very important strategy is to make sure you hire a solid SEO firm which is an expert in building websites for law firms. If you have great SEO from the start it is possible to be on page 1 of the search engines within a couple of months of a new website being released. Will you be there for the most competitive phrases at that point? That depends on the practice area - for a competitive practice area, no probably not however that doesn't mean that you aren't generating business as long tail phrases are often even more important than vanity phrases. What will be important is building some high quality inbound links to your site which will help start to build its credibility. What I typically see is that a strong website will start coming up on page 1 for relevant phrases in around 4 to 6 weeks from release. After that time, as the credibility of the website grows the number of phrases and searches it will come up for will grow and therefore the performance will steadily improve.

Is duplicate content on the web a problem?

You may have heard that it's detrimental to your search engine success to have content on your website which is exactly or almost exactly the same as content on another site. A client recently asked me if this was true or not and it's a tough question to answer because the truth is that only the search engines know. That said I can give my opinion based on what I have observed and believe to be true. At FindLaw we have built over 35,000 law firm websites so we have lots of data at our finger tips. Based on what I've seen I believe that duplicate content won't HURT your website but you won't get rewarded for that content either. Generally speaking the more pages of content you have (written with SEO) the better your site will perform in the search engines. Obviously there are many other factors to the performance of your site however it's still true that 'content is king' (VERY closely followed by linking). So if you have a site which comprises mainly of duplicate content I don't believe that you will be penalized for that content, but at the same time you won't get the benefit of that content - essentially the search engines will just ignore it. Therefore a site built with mainly duplicate content is unlikely to have good performance since most of the content will be ignored and it would be like having a very small website.

The question begs though......why would you want duplicate content on your site? For some people it's simply that they aren't good writers or simply have no idea where to start. It's really worth looking at other sites to see how their content is written and by all means use it as inspiration for your own content however it's really not a good idea to simply 'copy paste'.

Brown Charbonneau - $6.5 million award to client

Congratulations to Orange County Business Trial Lawyer Gregory G Brown for an outstanding result for his client! Gregory Brown of Brown Charbonneau recently obtained an initial sum of $6.5 million for his client. This is only the first phase of the trial - the second phase will see Mr Brown seeking 25,000,000 for breach of fiduciary duty, violation of family code section 1101 and a shareholder derivative action. Mr Brown's client got a nasty shock when her husband died and she found out that the business she had helped build since the 1970s had been improperly transfered to a trust and she was then excluded from the company. There were 5 defendents and 5 law firms opposing Mr Brown during the trial.

Outbound links

A client asked me an interesting question this week. On his website he has many outbound links (that is links on his site which point to other websites) since he provides many resources he thinks his clients may be useful. His question was 'is it detrimental to SEO to link out to sites with a lower page rank than mine?'. It's a good question to which the answer is most definitely no. As long as the websites he is linking to make sense and are relevant sites for the people who visit his website there is no harm in linking to sites with a lower authority. If you think about it, how would those other sites ever gain creditibility/page rank if everyone was scared of linking to them without losing SEO value to their own sites? Outbound links to other relevant sites are not a problem however it should be noted that links to 'bad neighborhood' sites (porn, gambling etc...) can have a negative effect unless of course that's the nature of your business also.w

Just how important is it to have a good website?

I know that many law firms often ponder on whether it's really important to have a good website or not. I personally believe that it's of PARAMOUNT importance for a lawyer/law firm to have a great website (or any business for that matter). Your website is the first impression someone has of your practice - you don't want it to be the last. Many attorneys feel they don't need a good site because they get all their business via referrals but by saying that they are missing an important point. If someone asks around for a referral they may well ask several friends and end up with several names. Today's generation is quick to 'Google it' and will surely look up all the names they were referred to find out more about each of them and then decide who to call. If your website does not compare to your competitors, does not look professionally put together with a strong marketing message, there's a good chance you may loose that client to your competition.

Some could argue that as an internet marketing consultant by profession I'm maybe slightly biased, so let me share real life stories from some of my clients to support my claim.

Orange County Business Lawyer Paul Jacobs of Jacobs & Dodds is a based in Irvine, CA. Paul recently sent me this email:

"I had an interesting phone call with a new client today that I think you will appreciate. This individual called my office to talk about the other shareholders in his company buying him out so he can retire. I went over all of the things he needed to consider with respect to a stock buyout. I then asked him if he wanted to schedule an appointment, or, if he wanted to interview some other attorneys first. He replied that he was "sold" on using me on the basis of what he saw on my website."

Paul's not alone. Many of my clients have told me that their prospective clients arrived in their office already 'sold' on working with them because the website did a good job.

On the flip side of the coin I have also had attorneys tell me about why they LOST a client due to not having a site or having a poor website. Mr Green of Los Angeles told me a story which he says will always haunt him. A good friend of his referred a client to him who had a very interesting and complex business dispute. Upon hearing about the potential new client Mr Green was immediately excited. It was a great case, very interesting and was likely to be worth at least $250k to him to litigate. Sadly Mr Green was told that the prospective client decided that he didn't even want to discuss the case with him......because he didn't have a website. The prospective client felt that Mr Green's practice was not professional enough because of the lack of site. Now maybe that client was misguided in making that assumption, but the fact is that people definitely do make that type of judgement call. Needless to say Mr Green now does have a great website but is still frustrated at losing out on that opportunity!

Bankruptcy rejection turned around by Abel Fernandez

Congratulations again to the Diefer Law Group on another great result for its client. A married couple had approximately $50,000 in unsecured debt. After their first appearance the couple's application for bankruptcy was denied since the court said that they earned too much money. Luckily for them Attorney Abel Fernandez is extremely detail oriented and thoroughly studied their financial history. Upon close review of the client's pay stubs Atty Fernandez was able to see that the couple was claiming exempt on their wages and were not paying taxes. This meant that their income as seen by the court was not accurate as it was too high. Atty Fernandez had the couple change their exemptions to married with 2 dependents. After this change was made the couple qualified for Chapter 7 bankruptcy relief.

Missing Google Local Recommendations

Some businesses have noticed that many of their Google Local/Maps recommendations seem to have disappeared. One business owner noted that of his 153 recommendations only 98 of them were currently viewable. So the question is......what's happened? Where did they go?! According to a reliable source it has been known for recommendations to get disassociated from a business listing however as long as the listing hasn't changed, they should come back again at some point in the future. It may take some weeks (or even months) for this to happen, but hold tight if you've seen this to your listing as they should come back again.

Google's new search results page

If you've used Google in the last day or two may have seen the new layout of the search results page. The search engine giant is continually striving to improve in a bid to remain on top and state that the recent changes to their results page are due to 'rising expectations' for search on the world wide web. According to Google the changes are intended to improve user experience. Here's what a company representative had to say on a blog:

"As the web has evolved over the past decade, people have been typing more sophisticated searches and seeking out specialised search tools to match," said Jon Wiley, senior user experience designer.

"To keep pace with rapid change online, we have teams of engineers working across Google to develop new ways to present and refine search results. Our central challenge with our latest redesign was to figure out how to squeeze all these tools and technologies into a single page."

The new design, which includes the altered left hand results panel, should make it easier to navigate results, while being less distracting, Wiley added. "Our users want more powerful tools, but they also want the simplicity they've come to expect from Google,"

You'll notice that there's now a video search button prominently listed. For those businesses who have yet to includ video in their online marketing plans, this is yet more affirmation of how important it has become.

Many of the changes to the Google SERP are simply design changes, however this new release shows Google's continued commitment to staying ahead of the pack.

$100,000 in unsecured debt discharged

Congratulations to the Diefer Law Group on a great result for one of its recent clients. Attorney Abel Fernandez represented a married couple with 2 children who had approximately $100,000 in unsecured debt. $1.2m Jury Verdict for Brown Charbonneau

Congratulations to Brown & Charbonneau on its 7 figure jury verdict! Brown & Charbonneau represented a paving company against a general contractor related to a written subcontract to provide labor, services, equipment and materials necessary to perform onsite grading and related work on the Rhodes Elementary School in Chino Valley, CA. Brown & Charbonneau's client claimed that the contractor breached the subcontract by failing to pay the balance due, failing to make timely and complete progress payments, and failing to timely pay for change orders. Before trial, the client had previously settled with 2 other defendants for $1,100,000. Against the lone remaining defendant, the client sought $131,000 in damages. This defendant had never offered more than $2500! After an eight day jury trial, the jury entered a verdict in favor Brown & Charbonneau's client in the amount of $130,790.94 for breach of contract and $130,790.94 for quantum meruit. The key issue, however, is the recovery of the prevailing party attorneys’ fees which will be in excess of $250,000. This verdict brought the total recovery to $1,230,790 PLUS ATTORNEYS’ FEES.

Meta keywords used to be very important in the SEO world. A meta keyword is a list of keywords which is hidden behind the website in the code. Back in the early days of SEO (around 1995) meta keywords were an effective way to create a website with a strong presence but that's not the case anymore. The search engines quickly figured out that meta keywords (also known as meta tags) are an ineffective way to measure the relevance of a web page. Google was the first to ignore these tags and was quickly followed by the other major search engines. In today's ever changing SEO landscape content and inbound links are the most important part of a website, however many SEOs still add meta tags to their sites simply to appease any client who may think that it's important. I'm often asked by clients if we can add a page of content on a specific topic to get them prominent in the search engines quickly when there is breaking news, for example if a plane crashes an aviation law firm wants to be found for people conducting a search about that specific crash. Regrettably, adding content/using search engine optimization is not the best way to get prominence quickly. The search engines are indexing frequently but it could be days or even weeks before the new content is indexed and even then it may not pop up right away. Caffeine - Google's new upgraded search engine

You may have heard the buzz - Google is working on a new ugraded version of its search engine. All the search engines are continually improving in a bid to stay ahead of the competition. With the launch of www.bing.com Google is more than ever trying to stay on it's toes. The new version of Google is slated to provide improved speed, accuracy, size and comprensiveness of search. Since the beta version of Caffeine (for developers) was recently released, many have already conducted their own research to see how it performs. Here are the results from one such search:

Speed:

Using a simple search (the word 'dog') the new Google brought back results in a lightning fast 0.12 seconds as opposed to 0.25 on the regular Google. Pretty impressive!

Accuracy:

The tester entered his own name in quotes. Many of the new blended search results didn't appear in the new version but this does not change how relevant the results are. Results from both the old and new were good and relevant results but the new Google search page was the most relevant.

Breaking news:

Both versions of Google performed equally well based on a new search.

Size of results:

It was determined that the new Google has a much larger index. The old Google yielded 51 million results for 'dog' whereas the new yielded a whopping 359 million.

The conclusion - Caffeine is definitely WAY faster than the original. With regards Google's other claim's time will tell.

Law firm strategy - does focussing on the highest paying cases really bring the most revenue in the long run?

When I meet with attorneys a question I frequently ask is 'how do you choose which cases or clients to take'? The answers I receive will vary depending on the practice area. Personal injury, employment law and other attorneys which typically work on a non contingency basis typically seem to choose based on a) chances of winning the case and b) the potential verdict or settlement. Contingency based lawyers are typically looking for a) a client who can pay the bills and b) a case which will generate significant billable hours to make it worthwhile. While there is certainly logic in this methodology I recently met with an attorney who had a different point of view which I thought was extremely smart. When asked this same question, he responded - 'it's simple - I take the clients I think I can make happy'. To get confirm my understanding I asked 'so you mean you take the cases you think you can win' assuming that was his definition of making a client happy. 'No he responded - regardless of what I think the outcome could be, just that I feel I can make happy.' He went on to further clarify that he didn't care about the potential legal fees or the size of the case - he simply focuses on those people he believes he can make happy so that they then refer their friends and acquaintances. Throughout the case, with each invoice the client also receives a satisfaction survey. Responses are carefully screened - if anyone is not happy they are contacted immediately. If the firm does not think they can make them happy they will graciously cut them loose. If a client goes several months without responding to the satisfaction survey they are contacted and asked the quesitons verbally. The attorney further explained his methodology - to him reputation and word of mouth are of paramount importance. He said if just one person was walking around being negative about his firm that was damaging. Instead he has a huge number of happy clients who only have great things to say about his firm and are always eager to refer his name when a friend has a need. The business receives huge numbers of referrals each month and is continues to grow and prosper when other law firms are struggling. It's clear to me that there is a lesson to be learned from this wise business savvy attorney. In today's challenging economic times, more than ever it may be easy to focus on the high paying cases but is that the best long term strategy for your practice? It's a question worth seriously considering.
